Student Rights

    • Students have the right to freedom of speech and expression.
  • Religion at School
    • The separation of church and state that usually precludes the practice of religion in school is not absolute. There are exceptions that must be recognized.

    • Student records, grades, and activities are protected from those who have no right or business with them.

    • A student who is subject to discipline has the right to due process of law.

    • The Harassment, Intimidation, and Bullying (HIB) law requires school districts and administration to protect students from a hostile environment.

    • Student discipline must be fair and just and be coordinated with the offense.

School Safety

  • School Violence
    • School districts and administrations have an obligation to prevent violence on campus.
  • Weapons at School
    • Weapons of any kind are forbidden on campus, and schools must be proactive in detecting and confiscating any weapons and removing dangerous students from campus.
  • Medication at School
    • Districts and schools must have a written policy regarding student medication, prescription requirements, administration requirements, and student health protocols, including vaccinations.

Discrimination at School

  • Desegregation and Busing
    • Districts must conform to relevant statutory and case law regarding the equality of student populations and must not allow facilities heavily weighted by race, color, or any other discernible characteristic.
    • Districts must integrate their schools, even if segregation exists by accident.
  • Sexual Harassment
    • For students, teachers, and staff, this is absolutely forbidden. Once reported to the district administration, an investigation must be undertaken.
  • Bilingual Education and Equality
    • Students have a right to a free and appropriate education in a thorough and efficient public school, no matter their language, origin, or any other superficial characteristic.
